Welcome to the Virgin Active HeavenV website. We know you want to get stuck in, but it’s important that we cover a few bits and pieces with you about the content, how you can contact us, data protection, our liabilities and, you know, the legal stuff.

You probably think it’s all pretty boring, but our lawyers say these terms are important and that you should read them because, by using our site, you’re indicating that you accept and agree to comply with these terms. We may amend these terms (especially if we add new products or features to our site), so check them regularly; your continued use of our site will indicate that you accept and agree to any amendments.

About use of our site

3) You agree to use our site in accordance with these terms and conditions, only for lawful purposes and in a way which does not infringe the rights of anyone or restrict or inhibit anyone’s use and enjoyment of the site. If you don’t comply with these terms, we may deny you access to our site.

4) If you wish to make a HeavenV booking, you should follow the instructions for making a booking that appear on the site. Any booking that you make will be subject to your agreement to further terms and conditions in respect of that booking. We will notify you of the relevant terms and conditions which you will have to accept to complete your booking.

5) You may download and print content from our site only for your private, personal and non-commercial use. We do not guarantee or warrant that any material available for downloading is free from infection, viruses, trojans and/or other contaminating codes.

6) You agree to provide information that is truthful and accurate. You agree to use the enquiry and booking forms on our site to make only genuine enquiries and/or bookings for you or for other persons for whom you are authorised to act.

7) You will not use the site to send by e-card, email, post or otherwise transmit any material that is unlawful, threatening, abusive, defamatory, invasive of privacy, vulgar, obscene or profane.

8) You agree not to reproduce, distribute, modify or re-post our content on another site, frame or mirror our site or link to our site without our prior written consent.

9) You grant to us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide licence to use (including but not limited to publishing, exploiting and modifying) any material you email, post or submit to us. For the avoidance of doubt, we will be free to use any ideas, concepts, know-how, content, text or images contained in your communications with us for any purpose whatsoever, to the fullest extent permitted by law.

About access to our site

10) We try to update our site regularly, so we may have to suspend access, service or functionality on our site from time to time, without notice. If required, we may have to close our site indefinitely. We will not be liable for any direct or indirect loss you may suffer if, for any reason, our site is unavailable at any time or for any period of time. Some of the images that appear on our site are generic images: not all images of facilities on a club’s page of the site may be of the club on that page.

11) As information or data transmitted to or from our site passes over public telecommunications networks, we can’t promise that the operation of our site will be secure, confidential, uninterrupted or error-free. You agree not to do anything that does or may interfere with the proper working of the site including but not limited to tampering with, or hacking into, the site or the servers on which it resides.

12) Our site may have some sections accessible only by a user identification code and/or password ("pass codes"). From time to time, we may restrict access to those sections, or to the entire site, to users who have registered with us. If you choose, or you are provided with, a pass code, you must treat such information as confidential and only use it yourself. We may disable or suspend your access or any pass code, whether chosen by you or allocated by us, at any time in our sole discretion. Our issuing of pass codes is not a promise of continued use or access to the site or any data you might store on it.

About content on our site

13) We own, or are the licensee of, the intellectual property rights in the content of our site including, but not limited to text, photos, graphic designs, images, audio, video recordings and any data entered or stored by you (the intellectual property rights in which you assign to us).

14) VIRGIN and Virgin Active and the Virgin signature logo are registered trademarks of Virgin Enterprises Limited (registered company no. 01073929, registered office at 120 Campden Hill Road, London, W8 7AR) and are used under licence by Virgin Active Limited.

15) Use of our site does not give you any right to use or reproduce any of its content, the trade marks or other intellectual property on it.

16) Our site may contain links to third party sites and resources. We have no control over the contents of those sites, resources or third parties and accept no responsibility for them, or for any loss or damage that may arise from your use of them. We do not review, censor, approve, edit or endorse any information placed on third party sites or resources.

About prices

17) While we try to make sure all the information and prices on our site are up-to-date, we reserve the right to change prices at any time. We’ll let you know of any changes in price by amending the rates displayed on the site. If there is any discrepancy between the prices set out on our site and those set out in a price list in clubs, the price list at our clubs shall take precedence.

About your privacy

18) Your information is safe with us. Rest assured, we collect and process your personal information in accordance with the Data Protection Act 1998, the Privacy and Electronic Communications (EC Directive) Regulations 2003 and all other applicable data protection legislation, as amended from time to time.

19) When you use our site or contact us by post, telephone, fax, email or SMS, we collect, store and use certain personal information that you disclose to us. This includes details such as your name, address, telephone, fax, email and mobile phone number. We may also collect details of your computer’s internet protocol address and other details about your computer, which is automatically collected by our web server.

20) Other than as set out in the rest of this paragraph we will not share your personal information with third parties for marketing or any other purposes without your consent, unless we are required to do so by law. When you request information from us in one of our clubs or make an enquiry, we add you to our database and:

(a) may contact you with relevant promotions, offers or information that we feel may be of interest to you, from time to time;
(b) may pass your details to third parties offering services linked to your information request or enquiry who may contact you with relevant promotions, offers or information; and
(c) where we have your consent, we and other Virgin Companies my contact you with relevant promotions, exclusive offers or information that we feel may be of interest to you.

22) Did you know that countries outside the EEA may have a lower standard of protection for personal information? If we send your data to a company outside the EEA, we’ll do our best to ensure that they process your personal information in accordance with principles consistent with the Data Protection Act 1998 and the Privacy and Electronic Communications (EC Directive) Regulations 2003, as amended from time to time.

23) We have technical and organisational security measures in place to prevent the loss of or unauthorised access to your personal information. While we do our best to ensure the security of your data, we cannot guarantee the security of information transmitted over the Internet.

About cookies

24) We use "cookies" to store and collect information regarding your usage of the site. These types of cookies aren't the edible kind (darn it!). They're small pieces of information stored by the browser on your computer's hard drive. They send information stored on them back to our web server when you access our site. It helps us to know what you’re viewing on our site and how you navigate around the site, which ultimately helps us make improvements to the site.

About our liability

25) The material on our site is provided without any guarantees, conditions or warranties, including warranties of merchantability, non-infringement of intellectual property, fitness for purpose, or accuracy or completeness of any information.

26) To the extent permitted by law, we, other members of our group of companies and third parties connected to us exclude:

(a) all conditions, warranties and other terms which otherwise be implied by statute, common law or the law of equity; and
(b) any liability for any direct, indirect or consequential loss or damage incurred by you in connection with our site or in connection with the use, inability to use, or results of the use of our site, any sites linked to it and any materials posted on it, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

27) Except as expressly set out in these terms, all representations, warranties, conditions and other terms implied by statute, common law or otherwise are excluded to the fullest extent permitted by law. However, nothing in these terms is intended to exclude our or your liability for death or personal injury arising from negligence.

28) Commentary and other materials posted on our site do not amount to an offer to contract or advice on which reliance should be placed, and we do not intend that you should interpret it as such. We disclaim all liability and responsibility arising from any reliance placed on such materials by anyone visiting our site, or by anyone who may be informed of any content on our site.

About changes

29) From time to time, we may update and change these terms without notice. You’ll always find the latest version of these terms on the virginactive.co.uk site. Your continued use of our site will indicate that you accept and agree to any amendments.

About other bits and pieces

30) If any of these terms are held to be illegal, invalid or unenforceable by any court of competent jurisdiction, the remainder of these terms will continue in full force and effect.

31) The English courts will have non-exclusive jurisdiction over any claim related to a visit to our site. These terms of use will be construed in accordance with, and governed by, English law.

32) You agree that any of our related companies may rely on and enforce these terms, but otherwise we and you agree that no other third parties are to be given any rights under the Contracts (Rights of Third Parties) Act 1999.

33) You agree that we may assign or novate these terms to anyone without notice to you.

3 for 2 Pre-Christmas Party treatments
  1. The Offer is only open to Eligible Persons. An Eligible Person is a UK resident who is aged 16 years or over (an “Eligible Person”). Virgin Active Limited reserves the right to verify the eligibility of Eligible Persons.
  2. This Offer is available at HeavenV at any of the following Virgin Active clubs: Bank, Barbican, Chelmsford, Crouch End, Derby, Edinburgh Life, Edinburgh Omni, Farnborough, Leeds Life, Manchester Didsbury, Merton Abby, Mill Hill, Moorgate, Northampton, Nottingham, Preston, Sheffield, Solihull, Staines, Strand, Thundersley, West London and Wokingham (the “Club(s)”).
  3. If an Eligible Person purchases two treatments from List A of the Christmas Party Packages from HeavenV at a Club before HeavenV’s closing time at the Club (which is specified on the website) before or on 31st December 2011 (“End Date”) the Eligible Person will receive a Complimentary Treatment from List B without charge (the “Offer”).
  4. The following Christmas Party Packages are available under this Offer: List A - Prescriptive Facial; Full Body Massage; Lycon Brazillian Wax; Lycon Hollywood Wax; Exfoliation Body Scrub; Jessica Manicure; Jessica GELeration; Jessica Pedicure.
  5. The following Complimentary Treatments from List B are available: List B - Eyelash Tint; Eyebrow Tint; File & Polish for Fingers; File & Polish for Toes; Under Arm Wax; Eyebrow Reshape.
  6. An Eligible Person can only purchase up to ten Christmas Party Packages under this Offer before the End Date.
  7. All Christmas Party Packages purchased under this Offer (and Complimentary Treatments) must be redeemed together at a Club before HeavenV’s closing time at the Club (which are specified on the website) before or on the End Date. Failure to do so will result in the Package and Complimentary Treatment being invalid and Virgin Active Limited reserves the right to refuse a refund or perform a Holiday Package and Complimentary Treatment after the End Date.
  8. Virgin Active reserves the right to refuse entry to any person if it suspects abuse of this Offer or otherwise in its reasonable discretion.
  9. The Offer is non-transferable, non-exchangeable and cannot be redeemed for cash.
  10. Redemption of this Offer shall mean that Eligible Persons will be deemed to have fully and unconditionally accepted and agreed to be bound by these Terms and Conditions and Virgin Active’s decisions.

  5. The following Complimentary Treatments are available: For Holiday Package 1 - a file and polish for fingers and toes and for Holiday Package 2 - a full body scrub (collectively, the “Complimentary Treatments”).
  6. An Eligible Person can only purchase up to ten Holiday Packages under this Offer before the End Date.
  7. All Holiday Packages purchased under this Offer (and Complimentary Treatments) must be redeemed together at a Club before HeavenV’s closing time at the Club (which are specified on the website) before or on the End Date. Failure to do so will result in the Holiday Package and Complimentary Treatment being invalid and Virgin Active Limited reserves the right to refuse a refund or perform a Holiday Package and Complimentary Treatment after the End Date.
  8. If an Eligible Person takes advantage of this Offer it will be able to purchase a St Tropez or fake Bake spray tan treatment at a discounted price before the End Date. This spray tan treatment must be redeemed at the Club at or around the same time as the Holiday Package and Complimentary Treatment is performed.
  9. Virgin Active reserves the right to refuse entry to any person if it suspects abuse of this Offer or otherwise in its reasonable discretion.
  10. The Offer is subject to agreement of the Club Rules (available at each Virgin Active health club and on the website) these terms and conditions (the “Terms and Conditions”) and upon satisfactory completion of a pre-activity medical questionnaire and patch test (for eyelash and brow tints which are required at least 48 hours before the treatment).
  11. The Offer is non-transferable, non-exchangeable and cannot be redeemed for cash.
  12. Redemption of this Offer shall mean that Eligible Persons will be deemed to have fully and unconditionally accepted and agreed to be bound by these Terms and Conditions and Virgin Active’s decisions.
